What GDPR and accounting obligations apply to nonprofits?

GDPR — Mandatory for all nonprofits

As soon as an association collects the name, first name, email or phone number of a member, it is subject to GDPR. Administrative AND criminal penalties are possible. A register of processing activities is mandatory. No CNIL declaration required since 2018, but internal obligations are stricter.

Rights of individuals

Members, donors and volunteers have the right of access, rectification, erasure and portability of their data. The association must be able to respond to these requests within 30 days. A privacy charter is recommended. Appointing a DPO is possible.

Accounting and grants

Associations receiving more than €153,000 in public grants must publish their accounts. Accounting must comply with the nonprofit chart of accounts. Accounting documents must be retained for 10 years. The use of grants must be traceable and documented.

Is our association really subject to GDPR?
